Attorney General David Eby says he has no timeline for getting a decision in a reference case that the government is taking to B-C’s Court of Appeal over the Trans Mountain pipeline expansion. The N-D-P government is seeking affirmation that it has the right to protect its environment from the threat of a heavy oil spill, in a case that Eby says could be appealed all the way to the Supreme Court of Canada. It’s the latest move in the escalating dispute over the 7.4-billion-dollar project which would double an existing pipeline from Edmonton to Burnaby. The reference case throws further uncertainty on the project, as it’s unknown if a decision can be reached before Kinder Morgan’s May 31st deadline for getting assurances that the expansion can proceed without more delays.
