British Columbia says it wants to be proactive by trying to prevent any potential harm from an oil spill, telling the provincial Court of Appeal that it knows it can’t stop the Trans Mountain pipeline expansion. But the province’s lawyer, Joseph Arvay, says it can enact environmental laws to reduce the harm from a pipeline spill. B-C’s Court of Appeal is considering a reference case filed by the province that asks if it has jurisdiction to regulate the transport of oil through its territory and restrict bitumen shipments from Alberta. Alberta Premier Rachel Notley and Prime Minister Justin Trudeau say only Ottawa has the authority to decide what goes in trans-boundary pipelines.
